I know I shouldnt have signed on the employment letter, who stated that if you worked for less than 1 year, you are to pay the company 2 months of your salary as compensation
But if you do not accept this clause, how can you work for this company. alot of my colleagues are unhappy with this HR clause, but what to do.
I worked in this company for less than 1 year and I tendered. I rec a letter from this company recently asking me to pay up on a certain date, if not will face legal action. somemore, I was not paid for the 2 weeks notice I served, like working for free and I feel its not right. I do not intend to pay up. the most they sue me and if they win, I say I dun have money. even if I have, I will pay them by instalment, thats the worst case scenario. going to MOM is useless as I am not covered under the employment act. I am an executive by the way.
i think such clause is absurb. Bring to MOM and see what they say.
Unless u immediate go, than i understand must pay the company 2 months (provided yr tender notice is 2 month)

MOM don't care much about the employees, they care more for the employers and foreign workers. I believe they will say it is the company's policy as such they are not able to help.
Franceso, do you mind let us know what industry is your company in ? How big is the company? Hope to avoid working in such a company.

in the private education section. the company is a big player in this industry. working there sucks man. alot of manual work and company dun want to invest in better systems. I guess it is saving costs.

private education. location all I can say is West side haha. wait company learn of this and start to sue me for defamation. lot of high staff turnover.

A certain local big supermarket also had these terms in their contract
You are obligated to work overtime, on weekends, or on public holidays if necessary, and you will not be entitled to any compensation in the form of overtime pay or off-in-lieu
Basically, they wrote into the contract that you are a slave to them.
I told my friend not to sign the contract, and to specifically highlight this clause to whack.
The HR said it's just written in for convenience, but its not really executed.
In that case, why write it in?

For your case, maybe write into MOM an email to ask what you should do, though I suspect they will just tell you to find a lawyer should that happens. I used to have a clause in my contract, stating that I am not to work for any rival company that is in the same business as my ex-company for 2 years, starting from the effective date of my resignation. But I understand that in court, this clause is not really enforceable.

he said it is between me and the employer, nothing much MOM can do about it. he also advised me to get my own lawyer if the company is serious in taking legal action.
The money the company have to pay to employ a lawyer to sue you is probably more than your 2 months salary.
Even if you lose the case, they still make a net loss leh.
Say lawyer fee is 10k. You pay them 2 motnhs salary which is 6k as compensation. They still lose 4k leh
the company gave me 2 weeks to pay up, failing which they will take legal action.
in closing, it wrote,we reserve all our rights on the above matter lol.

students who study for halfway, dropout still need to pay for the balance of the course fee. letters have been sent to them to demand them to pay up, if not legal action will be taken. worse is those who signed and then drop out after 1 or 2 modules.

Not necessary.
They can argue that if you pay upright, its 2 months.
But if you refuse to pay, then they can pursue a court case, in which they can ask for the 2 months + court fees incurred + lawyer fees incurred.
Maybe even psychological trauma costs incurred by the company (just kidding)
It is up to the judge to decide how much the losing party should pay. Of coz, outside of the legal things they can do, there are things called loss of reputation, loss of face (for 'bullying' a small employee), which are quite impt for a company.
I thought MOM has upped the protection from 1.6k to 2k? Pls double confirm, I remembered some months back, this has changed.
Any employers that cooked up such conditions in your work contract is not worth working for.Be very careful where you put your signature next time.
The thing is since u sign already....there is nothing much u can do with it.....at least the lesson learn is to read everything carefully before u put down ur pen next time...
